FREE THIRTY (30) DAY NiMH MODULE LIMITED WARRANTY

BattMech a division of GlobalTech Environmental Corp. offers a FREE Thirty (30) Day NiMH Module Limited Warranty when Module(s) are purchased directly from BattMech and used for BattMech’s recommend use. The recommended use is within a specified make, model, and year, per description purchased within the module description on www.BattMech.com.

LIMITED WARRANTY COVERS RESIDENTIAL VEHICLE USE ONLY.

THIS WARRANTY DOES NOT COVER VEHICLES USED IN COMMERCIAL USE.

Terms of the limited warranty are as follows:

Definitions.

NIMH: Nickel Metal Hydride Battery abbreviation

Battery Modules:  A container consisting of one or more cells, in which chemical energy is or was converted into electricity and used as a source of power. Sometimes referred to as a battery cell(s) (“Module” and or “Cell”).

1. The Thirty (30) Day NiMH Module Limited Warranty covers any battery pack used in a residential vehicle if module fails due to defects in materials or workmanship of battery module, under normal installation, use and service, during the warranty period. It does not cover a module that is used for commercial use in any way. The warranty period begins the date the item is ordered and paid for and extends for Thirty (30) Days, from purchase date of module. For any claim covered by this warranty, BattMech, at its discretion, will arrange for the repair of your module, or replacement of comparable quality, or will refund claimant for the original cost minus fees and shipping costs, of the purchase at BattMech’s option.
2. Refund, repair, or replacement of failed module will be issued once BattMech receives and verifies condition of failed module for claim legitimacy. Return shipping cost and arrangement to BattMech of failed module for claim are the claimants responsibility and these costs will not to be refunded by BattMech. The Warranty Period does not renew, instead continues from original purchase date, if a module is repaired or replaced under this warranty.
3. This warranty does not cover module(s) that are merely discharged, or that fail due to abuse, misuse, neglect, fire, accident, collision, explosion, freezing, theft, overcharging, alteration, improper installation, used for something other than its intended use, unauthorized attempt to repair, or failure to keep the battery properly maintained.
4. WARRANTY VOID IF:

1. • Damage is done to QR code on Module.
   • Module(s) have been CHARGED or DISCHARGED prior to installing into a vehicle.
   • Module(s) were not installed by a certified automobile repair technician.
   • Battery Air Filter was not cleaned and kept clear of obstructions. (Clean every 3 months)
   • Module(s) has depleted to less than 20% State of Charge (SOC) due to running out of fuel, engine or regenerative system malfunction, or user error. An example of user error is leaving the vehicle in neutral for extended periods while vehicle turns on. In this example, the engine is unable to recharge to the HV Battery that may result in permanent damage.
   • Presence of any of the following diagnostic codes: P3191 (Engine Does Not Start), P3193 (Fuel Run Out), P3190 (Poor Engine Power), P0A0F (Engine Failed to Start), C1256 (Accumulator Low Pressure), or their equivalent manufacturer diagnostic code. These diagnostic codes indicate the vehicle is unavailable to recharge the HV Battery that will lead to permanent damage.
   • Any reason given that may void warranty within this limited warranty not listed in Section 4.
   • The following information cannot be supplied to BattMech at the time a claim is made:

a) Error code after scanned by OBDII (Picture/Screen Shot)

b) Battery Volt by OBDII reader.

5. To file a BattMech Limited Warranty claim email [email protected]. Please put in the subject heading, “Limited Warranty Claim”. Include in the email: name, business name if applicable, address, phone number, original purchase ID. A customer service specialist will contact you to guide you through the process.
6. A claim to Warranty is voided if not received within 30 days after the failure/defect occurs.
7. Any claim must be brought in an individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiffs, or similar proceeding (“Class Action”). The Purchaser expressly waives any ability to maintain any Class Action in any forum. No one shall have authority to combine or aggregate similar claims or conduct any Class Action nor make an award to any entity or person not a party to this agreement. Any claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void, or voidable may be determined only by a court of competent jurisdiction.
8. BattMech will automatically activate the limited warranty for purchaser. BattMech will use the checkout/purchase date that the battery pack or packs are purchased from BattMech as start date.
9. The validity of all warranty claims is reviewed and decided by BattMech. BattMech makes no warranties except as expressly provided in this limited warranty.  BattMech will not be liable for any punitive, consequential, or incidental damages, such as the cost of installation, towing, electrical system tests, charging a battery pack, rental vehicles, labor, loss of time, loss of use of a vehicle, loss of life, lost profits, or damage to property other than the battery pack.
10. The terms of this limited warranty are Purchasers sole and exclusive remedy with respect to the purchase of your BattMech battery pack. The laws of Wisconsin will apply to this warranty and any claims or disputes with BattMech involving the purchase, use, performance, or return of your BattMech battery pack. This choice-of-law provision is intended to be given the broadest possible scope and applied to all claims and disputes, without regard to conflict of laws rules.
11. This warranty and agreement shall be governed by and construed in accordance with the internal laws of the State of Wisconsin, United States of America, without giving effect to any choice or conflict of law provisions or rules.  Any legal suit, action or proceeding arising out of or related to this Agreement or the matters contemplated under this Agreement shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wisconsin each case located in the city of Madison and County of Dane and each Party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding and waives any objection based on improper venue or forum non conveniens. Service of process, summons, notice or other document by mail to such Party's address set forth herein shall be effective service of process for any suit, action or other proceeding brought in any such court.

Bus Bar:  Copper and or Nickel metal plate found on the orange electrical harness that connects to the battery terminals.

1. The Thirty (30) Day Battery Pack Limited Warranty covers any battery pack used in a residential vehicle if battery pack fails due to defects in materials or workmanship of battery pack, under normal installation, use and service, during the warranty period. It does not cover a battery pack that is used for commercial use in any way. The warranty period begins the date the item is ordered and paid for and extends for Thirty (30) Days, from purchase date of battery pack. 2. Refund, repair, or replacement of failed battery pack will be issued once BattMech receives and verifies condition of failed battery pack for claim legitimacy.    • Old bus bars are not returned after being replaced with new bus bars that are included in the purchase; this is to ensure that your new bus bars were installed to ensure optimal battery condition and life.
   • Damage is done to any of the QR codes on Module within packs.
   • Battery Air Filter was not cleaned and kept clear of obstructions. (Clean every 3 months)
   • Modules within pack are rearranged from original configuration sent. Your BATTMECH battery pack is professionally balanced and ordered to ensure peak performance.
   • Not all original Modules sent within a pack are present upon return of pack for warranty claim.
   • Modules have been CHARGED or DISCHARGED prior to installing into a vehicle.
   • Modules were not installed by a certified automobile repair technician.
   • Vehicle has not been started and driven for at least 30 minutes every 30 days.
   • Battery has depleted to less than 20% State of Charge (SOC) due to running out of fuel, engine or regenerative system malfunction, or user error. An example of user error is leaving the vehicle in neutral for extended periods while vehicle turns on. In this example, the engine is unable to recharge to the HV Battery that may result in permanent damage.

10. The terms of this limited warranty are Purchasers sole and exclusive remedy with respect to the purchase of your BattMech battery pack. The laws of Wisconsin will apply to this warranty and any claims or disputes with BattMech involving the purchase, use, performance, or return of your BattMech battery pack. This choice-of-law provision is intended to be given the broadest possible scope and applied to all claims and disputes, without regard to conflict of laws rules.
11. This warranty and agreement shall be governed by and construed in accordance with the internal laws of the State of Wisconsin, United States of America, without giving effect to any choice or conflict of law provisions or rules.  Any legal suit, action or proceeding arising out of or related to this Agreement or the matters contemplated under this Agreement shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wisconsin each case located in the city of Madison and County of Dane and each Party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding and waives any objection based on improper venue or forum non conveniens. Service of process, summons, notice or other document by mail to such Party's address set forth herein shall be effective service of process for any suit, action or other proceeding brought in any such court.

The length of the warranty depends on which level of the warranty is purchased at the time of checkout. The recommended use is for the specified make, model, and year, per description purchased within the battery pack description on www.BattMech.com.

LIMITED WARRANTY COVERS RESIDENTIAL VEHICLE USE ONLY. THIS WARRANTY DOES NOT COVER VEHICLES USED IN COMMERCIAL USE.

Terms of the limited warranty are as follows:

Definitions.

Core: Original battery modules/cells that are coming out of the battery case that need replacing. These can be either Lithium Ion (Li-Ion) or Nickel Metal Hydride (NiMH) chemistry types. These are Generation 2 or newer if NIMH and originally produced by Panasonic in Japan.

Battery Pack: New cells/modules purchased from BattMech by Purchaser, usually to replace core. The battery pack can consist of 20, 28, 34 or 40 cells/modules of Nickel Metal Hydride design.

NIMH: Nickel Metal Hydride Battery abbreviation

Bus Bar:  Copper and or Nickel metal plate found on the orange electrical harness that connects to the battery terminals.

Battery Modules:  A container consisting of one or more cells, in which chemical energy is or was converted into electricity and used as a source of power. Sometimes referred to as a battery cell(s) (“Module” and or “Cell”).

1. The Twelve (12), or Twenty-Four (24) Month Battery Pack Limited Warranty covers any battery pack used in a residential vehicle if battery pack fails due to defects in materials or workmanship of battery pack, under normal installation, use and service, during the warranty period. It does not cover a battery pack that is used for commercial use in any way. The warranty period begins the date the item is ordered and paid for and extends for Twelve (12), or Twenty-Four (24) Months, not more than 365, or 730 days, from purchase date of battery pack. For any claim covered by this warranty, BattMech, at its discretion, will arrange for the repair of your battery pack, or replacement with a battery pack of comparable quality, or will refund claimant for the original cost minus fees and shipping costs, of the purchase at BattMech’s option.
2. Refund, repair, or replacement of failed battery pack will be issued once BattMech receives and verifies condition of failed battery pack for claim legitimacy. Return shipping cost and arrangement to BattMech of failed battery pack for claim are the claimants responsibility and these costs will not to be refunded by BattMech. The Warranty Period does not renew, instead continues from original purchase date, if a battery pack is repaired or replaced under this warranty.
3. This warranty does not cover battery packs that are merely discharged, or that fail due to abuse, misuse, neglect, fire, accident, collision, explosion, freezing, theft, overcharging, alteration, improper installation, used for something other than its intended use, unauthorized attempt to repair, or failure to keep the battery properly maintained.
4. WARRANTY VOID IF:

1. • Core battery pack (original old, failed Module that these new Module are replacing) is not returned to BattMech within 30 days from purchase date of pack from BattMech.
   • Old bus bars are not returned after being replaced with new bus bars that are included in the purchase; this is to ensure that your new bus bars were installed to ensure optimal battery condition and life.
   • Damage is done to any of the QR codes on Module within packs.
   • Battery Air Filter was not cleaned and kept clear of obstructions. (Clean every 3 months)
   • Modules within pack are rearranged from original configuration sent. Your BATTMECH battery pack is professionally balanced and ordered to ensure peak performance.
   • Not all original Modules sent within a pack are present upon return of pack for warranty claim.
   • Modules have been CHARGED or DISCHARGED prior to installing into a vehicle.
   • Modules were not installed by a certified automobile repair technician.
   • Vehicle has not been started and driven for at least 30 minutes every 30 days.
   • Battery has depleted to less than 20% State of Charge (SOC) due to running out of fuel, engine or regenerative system malfunction, or user error. An example of user error is leaving the vehicle in neutral for extended periods while vehicle turns on. In this example, the engine is unable to recharge to the HV Battery that may result in permanent damage.
   • Presence of any of the following diagnostic codes: P3191 (Engine Does Not Start), P3193 (Fuel Run Out), P3190 (Poor Engine Power), P0A0F (Engine Failed to Start), C1256 (Accumulator Low Pressure), or their equivalent manufacturer diagnostic code. These diagnostic codes indicate the vehicle is unavailable to recharge the HV Battery that will lead to permanent damage.
   • Any reason given that may void warranty within this limited warranty not listed in Section 4.

Modules can be used for Residential or Commercial use vehicles and Limited Warranty would apply.
